Please read the terms listed below carefully.
When purchasing a website package from ModernMarkup, you agree to the following terms.
SECTION A. BILLING
You agree to pay the price listed on the website at the date of purchase. Any discounts apply only to the initial purchase unless otherwise specified. If you upgrade your package after the initial purchase, a one-time $20 upgrade fee applies. The "cancel anytime" text shown near the price allows you to cancel your subscription at any time. If you cancel within the first two weeks of purchase, a one-time $10 administrative fee applies. All payments are non-refundable except where required by law. The "Paid Business Photography w/ Website Slideshow" on the WebBasic plan costs $5 per image plus a $10 one-time setup fee.
SECTION B. CUSTOMER RESPONSIBILITIES
You agree to provide all necessary content, images, and information required for ModernMarkup to complete your website. Delays or incomplete submissions may result in delays to your website delivery.
SECTION C. INTELLECTUAL PROPERTY
ModernMarkup retains ownership of all code and design elements created by us unless otherwise agreed in writing. All templates are property of W3Schools, and are modified to suit client needs. You may use the finished website for your business purposes only.
SECTION D. SERVICE DISCLAIMER
ModernMarkup provides web design services on an “as-is” basis. While we strive for high quality, we do not guarantee specific business results, website traffic, or revenue.
SECTION E. ARBITRATION AND LIMITATION OF LIABILITY
Any disputes arising from these terms will be resolved through binding arbitration in New York, following the rules of the American Arbitration Association. ModernMarkup is an informal business managed by a minor, operating on a small scale, and will not be liable for indirect, incidental, or consequential damages exceeding the amount paid for the service.
SECTION F. TERMINATION
ModernMarkup reserves the right to suspend or terminate services if these terms are violated or if payment is not received.
